Why do I need a Lawyer (Solicitor) ?

Whether you are running a business or not, a Solicitor can be beneficial to you. Every adult person should have a Will and Enduring Power of Attorney. A Will is essential as if you dont leave a Will, your Estate will be dealt with under the laws of intestacy which can be expensive and complicating.

Legal Will

A Legal Will enables your Executor (who is the person appointed to administer your affairs pursuant to your Will) to sell your assets, deal with your liabilities, and effect a distribution to beneficiaries. A Will minimizes the risk of your loved ones being put in a position of conflict with each other as it makes your intentions clear. Without a Will, the job of trying to distribute the proceeds of sale of your assets and monies held in your bank accounts and other investments can be very difficult

Power of Attorney

An Enduring Power of Attorney is also an essential document for you to sign as it enables your Attorneys (who are appointed to handle your affairs pursuant to the Enduring Power of Attorney) if you are incapacitated or need somebody to assist you with handling your affairs should you, for example, need to travel overseas. An example would be if you were incapacitated and your family needed to sell your family home in order to place you in an aged care facility. Without an Enduring Power of Attorney the family would have difficulties if they were to attempt to sell the family home on your behalf. This would be easily resolved if the Attorney under Enduring Power of Attorney were able pursuant to the Enduring Power of Attorney to attend to the sale of the family home or to deal with your bank accounts to assist you in your daily affairs.
